WMSL at BC.... "hang 'em all, I say, hang 'em all....especially nasty neighbours who have caravans on my land" lolol!!

Don't think that is a very good background for a magistrate, lol... I do fancy it, though... a number of years ago, I was accepted at Nottingham University to read Law... we were then posted away... so I turned it down.... and then the posting got cancelled.

I was studying for a Law A level... got in at Nottingham without it as a mature student, but still felt the need to do it... but one of the boys was ill, and I couldn't leave him... R was serving overseas, and the A level exams were over a couple of days, in Birmingham... it just wasn't to be!

I was also offered a place at Nottingham to read Geography at the same time.... I never ever expected to get in... I was two hours late for the interview, even though I lived just 10 miles away... I got lost, lolol!! I was sooooo flustered when I went in.... they still saw me.... and it took me about ten minutes to realise the irony of my apology and excuse.... I am soooo sorry, I couldn't read the maps, there were roadworks and I got lost!!

When it was pointed out.... am afraid I giggled (I do that when I am nervous) that this was a Geography degree.... I replied that Geography wasn't just about reading maps, I hope..... and then a look of horror must have passed my face, cos they laughed, lol They then discussed my likes and dislikes..... injustice, cruelty to children, animals and old people, and I loved ginger biscuits and my dogs and cats. Yeh, I know.... I only filled it in cos I had to apply for three places, and I needed them all to be at Nottingham!! So I was a bit tongue in cheek.... my place was conditional on getting an A level in Geography lol.

My third was English and Journalism... it wasn't worded like that, and it was a double degree... I didn't get an interview for that one.... got offered an unconditional place.

But it wasn't meant to be, was it.... never regretted it though.

Ann, it was the English degree I wanted.... but I was so bowled over at being offered a place on the Law degree..... it was unconditional as well... that I panicked and realised I would have to go and play at A levels again, lol..... I then really wanted it! I was 35-ish, mind!!

Good morning Daff and all: *nods to the two lovely ladies in wigs:-))) Nice morning here in London, well it's not raining so that's good. Having my strong coffee and all is organised and ready for the family to arrive. My patio is looking very pretty and there is a tortoise (balloon) sitting happily amongst the pansies next to the Buddha.

Oh Ann..... Westonbirt is just so stunningly beautiful....... not been, only seen photos, but that is enough.... I will visit next autumn, I think! Have a lovely day, and take lots of photos.... I love autumn colours, I would have them everywhere if I could.

Maz, that image had me howling.... Jethro isn't so bad any more, but he used to hitch a lift with all the domestic appliances.... he still does accompany me when I do any swearing.... he likes to supervise, and get in the way.... his favourite is to crawl under the rugs to help me lift them *rolls eyes*

BC.... enjoy!! You will have a wonderful time!

My littlie will hopefully be here Friday night for a week or so...... as long as B's driving licence comes through, he had to send it off to get a new photo.... 10 years since his last one... but he should be ok to drive, if it doesn't arrive in time for Friday, shouldn't he? Mine is due to be changed next month, too.

The tortoise and the Buddha.... sounds like a bedtime story is in there, somewhere... I used to make them up for my two when they were little... should have written them all down, really.

Oh well..... wish me luck..... off to do battle with the planning department now, lol!!

We have had a lovely day. westonbirt was magical, the colours were beautiful, the sun shone and the sky was a brilliant blue backcloth. It was however, crowded, I had thought it might not be being Monday but there were so many there they opened the second car park by 11am. It was till possible to take photos unhindered though. We actually didn't walk the whole of the arboretum because of Tony's foot but we stuck to the seasonal trail and the Acer glade. We can do that because we are not paying by the day to go in being members. When we had walked round we sat outside and they have the food caravans there which are not there at other times of the year and we had an original Cornish pasty (made in Cornwall cooked on site) and a container of chips and a coffee and it was so lovely in the sun, really enjoyable. We got home about 3pm so had a lovely day out.

Ann, that sounds so lovely, I bet the pasty tasted good too... we have a park nearby and the trees are just turning, always later up here, so hope to get some pics...D has just rung and hooray, she has the elusive case, J is chuffed as some of his undies were in it...lol...

Daff, wishing you good luck with the council.why do they make things difficult, I have just recieved a renewal form for my blue badge, well It is like a book, the questions they ask. I need to sit down and re-read it, I am sure they could make it easier for folk to fill in.... hope the sun is shining were you are.....

I took 190 photos and am very pleased with most of them, lots to scrap when I have time and definitely some there for cards.

Daff, how did you get on with the planners? Hope all went to your satisfaction?

Ann, it sounds like a wonderful day.

My day has been... well, another learning curve, lol

The planners... well, I have been informed that there does not need to be any documentation because.... it is at their discretion! So technically, they can pop int anyone's garden and declare *I'll have a bit of this* lol.

However, I have scoured even more legal docs today... and it would seem that there has to be a public meeting, with compensation etc offered, and that the owner is supposed to agree to it... I am going to have to re-read it a few times, but to quick perusal, it looks as though this means that declaring a property *Open Space* means that it is declaring it *open to all* but this is not so in the instance of private homes... the VIEW is supposed to be open... I think our nasty neighbour has known about this, and has supposed, incorrectly, that this meant he was able to access when ever he felt like it. But he can't!

Now what I have to do is find out when this meeting was called.... and why I didn't know about it. If it was when we had tenants, there was a clear procedure in the tenancy agreement that tells what to do if mail for the owner arrived...... if it was in the last 4 years, well, there has been nothing.

So.. it looks like we have to apply... and pay... but can appeal... and claim our cash back... if I find more info to show that the local authority have not followed guidelines.

I now have to use the Freedom of information Act to find out when any of these meetings took place, what the decisions were.... and why I knew nothing of them. So far I have surfed and googled to within an inch of my sanity, lol... can find nothing!!

Well... back to the drawing board.

Daff, would it be better for your solicitor to do this? It would maybe be less stressful and she may well know a shortcut to getting the information. Are you saying you think that they have declared it open space since you bought the house? And if so what, if any other open space is there in the road? If there is other, do the people in the houses know about it? I imagine, if that sort of letter was sent, it would have had to be signed for. Has it been received and signed for by somebody else do you think?

Hiya Ann.... I don't know whether a letter has been sent... but the meeting should have minutes that were recorded, and a list of folk attending or the area that was under discussion... so that is what I'm looking for.... I have got back 4 years... but of course some won't be on file. But no-one else in the road has had permission recorded.... no docs...

I was told that it is only my house in the close... but the estate was open plan.... although there is no mention of it in the documentation.

My solicitor is not a specialist in this sort of law..... so I may have to change her, although I do trust her... she is very expensive, more than the average, lol £120 per letter, and there have already been 3, plus all the e-mails ands the telephone calls.and then there is her hourly rate..... but if I have an idea of where to look, I don't mind searching as well.... lol I just have to know.... otherwise I witter, lol But she is very thorough. And I am very impatient.

I have to say, I have slept better, lolol.... engaging the brain seems to be having a beneficial effect, lol

My feeling is that this is an over zealous department, and they have overstepped their remit... but I sooooo want that fence!! As soon as possible. I am rather worried that if I stall, it'll take forever... so maybe the best idea would be to pay up, and hope for the best..... I am currently planning the fencing so that it doesn't limit the view from the road, but that it clearly indicates a property barrier.... once it becomes officially classed as residential curtilige and assuming that this does happen, then I can plant what I like behind it, lol.... so the blackthorn and pyrocanthus it is, lolol

I will then have loads of info to do a retrospective claim if I can prove that they were negligent in the way they carried out their duty..... so I am working on three different types of scenario, here, lol!! Now... that is multi-tasking, lololol

Spose it is keeping you out of mischief, you have certainly got more patience than I (or T) have - he says he'd shove the fence up and let them contest it. I point out that is not the way to go about it, but he has no patience with jobsworths!!

What view are they supposed to have? Your garden? or the scrubby bit of grass? Is there a footpath down by your garden and 'his' to the field/parkland behind?

WMSL.... T and R are very like-minded, aren't they, lol

No right of way... the view is supposed to be the feel of being *open* rather than closed in.... and of course we have the horse chestnuts at the far end.... diseased... if they come down, there will be the 4 other oak, plus the majestic pylon. No footpath, all fenced off at the back, no right of way, ancient or modern....... it is a mystery to me

But it is all based on the *Open Space Act 1906*

Makes interesting reading.... it isn't very long, just two pages in it's condensed form.

But it still doesn't say under what circumstances, and why, private gardens can be *hijacked* in this way, lol... I am very puzzled!

I really am off to bed now, lol
